Attorney Joe Tamburino Shares Legal Insight with CBS News About Fatal ICE Shooting in Minneapolis

CBS News recently interviewed Attorney Joe Tamburino of Tamburino Law Group for his legal insight into the fatal ICE shooting of Alex Pretti in Minneapolis. According to reports, Alex Pretti was protesting ICE in Minneapolis, and he was licensed to carry a concealed firearm, which he brought to the protests. Based on what can be seen in the footage that has been released so far, it appears that he was holding his cellphone and was pepper-sprayed by an ICE agent when he tried to shield another protestor. After he was tackled to the ground, multiple agents disarmed him before shooting him several times, resulting in fatal injuries.

The incident has raised alarms about the methods of ICE and the federal government’s oversight of the immigration control agency.

In the interview with CBS News, Attorney Tamburino commented that it was unusual and concerning that the Department of Homeland Security (DHS) announced that it alone would be involved in the investigation of the fatal ICE shooting of Alex Pretti. Typically, the federal government works in tandem with local law enforcement agencies to share resources and information to seek out the truth. He even pointed out that other recent incidents involving federal agents have involved investigators from the DHS and local sources, which makes it all the more unusual for the DHS to take complete control of the Alex Pretti case.

Attorney Tamburino also told CBS News that it would be legally unlikely that a federal court would allow Minnesota to effectively remove ICE from its borders. However, he did think there was solid legal standing to the state’s case that asks the courts to require the preservation of all evidence related to the shooting. If that case is approved and the DHS reports that certain evidence has been lost or altered, it could cause even more legal ripples and challenges in the future.
